UNCONSTITUTIONALITY OF THE ORGANIC LAW ON PUBLIC INTEGRITY
The Plenary of the Constitutional Court of Ecuador, through Judgment 52-25-IN/25 dated September 26, 2025, declared the Organic Law on Public Integrity unconstitutional in its entirety due to procedural flaws.
As a result, all amendments introduced by said law concerning public procurement, criminal law, juvenile justice, judicial organization, public labor regime, financial matters, and migration shall be rendered ineffective from the date of publication of Judgment 52-25-IN/25 in the Official Gazette of Ecuador (Registro Oficial), with the exception of matters related to criminal law and enforcement of penalties, childhood and adolescence, and human mobility, for which retroactive effects are specifically and exceptionally provided.
Additionally, the related unconstitutionality was declared of the General Regulation to the Organic Law on Public Integrity; Resolution MDT-2025-032 dated July 24, 2025, issued by the Ministry of Labor; Resolution R.E-SERCOP-2025-0153 dated August 8, 2025, issued by the National Public Procurement Service; Resolution NAC-DGERCGC25-00000019 dated August 6, 2025, issued by the Internal Revenue Service; and Resolution MDT-2025-043 dated September 18, 2025, issued by the Ministry of Labor.
